Penalties for Assault and Battery

Assault and Battery are both misdemeanors.  The jail term for each is 6 months in the county jail and if committed against a policeman or fireman the penalty is doubled to one year.  Where the victim of the battery is hurt, the sentence is raised to 3 years in the penitentiary.  Should the victim be seriously injured the charge becomes Assault with a Deadly Weapon which carries a 4 year sentence.   Use of a firearm in the assault increases the sentence still further to 9 years.
