Kerry Armstrong and
Daniel F. Greene have secured multiple acquittals for a client facing child molestation
charges. The client, a former headmaster at an Army and Navy Academy,
had stood accused of 20 counts, some of which dated as far back as 1997.
As the San Diego Union-Tribune reports, 57-year-old Jeffrey Barton was first arrested in 2013 when he was accused
of molesting a cadet repeatedly from 1999 to 2001. More victims came forward,
including a pair that alleged that Barton had also molested him during
a 1997 ski trip.
Ultimately, the jury acquitted Barton four of the five charges from 1997
and deadlocked on the charges from the initial accuser. Vista Superior
Court Judge Harry Elias declared a mistrial on those remaining counts.
"He [Barton] appreciates the jury's service, but he is still waiting
for final justice," Attorney Greene told the press after the verdicts.
Despite some of the still unresolved threads of the case, Greene called
the acquittals that were reached "a testament to our system of justice."
Relying on Witness Testimony
Because the alleged offenses in this case happened so long ago, the case
against Barton relied on the credibility of witness testimony of seven
men—all of whom were accusers. Four of these accusers claimed that
Barton committed molestation in 1980s at other boarding schools as part
of an unrelated matter. These testimonies were allowed due to California's
controversial Evidence Code 1108.
Attorneys Armstrong and Greene expertly handled these cross examinations
and ultimately concluded before the jury that Barton was not a predator,
but the target of "rumors and innuendo." The jury agreed and
produced four not guilty verdicts. Barton currently remains in custody
and will appear in court again November 12 for a judge to consider how
to proceed with the remaining charges.
