Attorney Dan Greene, the Senior Associate at The Law Offices of Kerry L. Armstrong, APLC, was recently interviewed by Chris Merrill on KOGO AM about a criminal case that he is currently representing. Greene's client, David Angelo Drake, was arrested and charged with several counts of assault after it was alleged that he is responsible for a series of attacks in the North Park area. The 23-year-old has no criminal history, and has pleaded "not guilty" to 18 charges of assault, forcible sexual penetration and assault with intent to commit a specific felony – among others.
According to Attorney Greene, none of the women have identified his client in a lineup, and "no one person has identified Mr. Drake as the assailant." When David Angelo Drake was initially arrested, his bail was set at $855,000. It has since been raised to $5 million.
In the radio interview that Attorney Greene gave on KOGO AM, he explained that this wasn't a unilateral decision made by the judge; rather, he believes that it was simply a matter of procedure. Upon reviewing the charges, the District Attorney's Office pushed to increase the amount of bail that was initially set by police.
Since Drake is facing a number of felony charges, the bail is now a much heftier sum. Even so, prosecutors have not ruled out the possibility that more assailants could still be at large. According to Deputy District Attorney Jennifer Golovato, "the investigation is absolutely ongoing."
Attorney Greene has continued to express concern over the identity issues that are presented in this case, which is explained in an article on NBC 7 San Diego. Two of the seven alleged victims have even described two different attackers, neither of which match the description of Mr. Drake.
